Notice of Hearing: Proposed Assessments for Public Improvements

The City Council of the City of Moorhead will meet on Monday, September 23, 2019 at 5:45 pm in the Council Chambers at Moorhead City Hall to pass upon proposed assessments to be made as a result of permanent improvements which were made or completed.

The proposed assessment roll is on record and on file in the office of the City Clerk, Third Floor, City Hall, in the City of Moorhead and is open for inspection during the regular office hours (8:00 am to 4:30 pm).  Written or oral objections will be heard and considered at said hearing.  Please contact the City of Moorhead City Clerk at 218.299.5304 if auxiliary aids or services are required (two business days’ notice is required).  The benefiting property owners who have questions concerning these projects may call 218.299.5427 or visit the engineering division staff for further explanation prior to the hearing.

No appeal may be taken to the amount of an assessment unless a written objection signed by the affected property owner is filed with the municipal clerk prior to the assessment hearing or presented to the presiding officer at the hearing.

An owner of a parcel proposed to be assessed may appeal said assessment to the District Court pursuant to Minnesota Statutes Section 429.081 by serving a notice of appeal upon the Mayor or the City Clerk of the City of Moorhead within thirty (30) days after the adoption of the assessment roll and thereafter filing said notice of appeal with the District Court within ten (10) days after service of the same upon the Mayor and City Clerk.

Owners of said property proposed to be assessed for said improvements, which constitutes their homestead, and who are 65 years of age or older or by virtue of disability or a member of the National Guard or other reserves ordered to active military service, for whom it would be a hardship to make the payments, may apply for deferred payment of special assessment by making application with the City Accountant, Moorhead City Hall, in accordance with Minnesota Statutes Section 435.193 through Section 435.195.
